GRAHAM COUNTY — In less than a half hour Memorial Day, a Graham County Sheriff’s deputy was called out twice for gates being placed across roadways.
The first call came in at 1:47 p.m., when resident said she couldn’t access her home when a gate was closed across North Sanders Road, along with a sign saying “Gate has to remain closed or you will be trespassed.”
At 2:07 p.m., the almost exact thing happened on West Elementary School Road, when a gate was closed across the roadway, along with the posting of a no trespassing sign, preventing a man from driving to his home.
In both instances, the reporting parties claimed to have easements, and both asked if they would be arrested for opening the gates to go home.
The deputy responded if they both have easements, they are allowed to travel the roads, but the issue of whether the gates should be closed is a civil matter and must be decided in civil court.
